Victoria cops probed for brutality
VICTORIA, B.C. – Police are probing an incident during which a Victoria cop was filmed kicking a suspect as he lay on the ground.
A citizen made a video and posted it on YouTube.
“At around 12:30 a.m. three officers on foot patrol witnessed a fight involving eight males and saw a victim of an assault lying on the ground being kicked in the head by a suspect,” said Sgt. Grant Hamilton.
“The officers intervened and deployed OC Spray in efforts to disperse the crowd which had little effect. The officers eventually wrestled six people into custody,” he said.
“The victim found lying on the ground was rushed to hospital with a head injury, he was treated and released and is refusing to cooperate with police. The combatants were all released without charges approximately 45 minutes later.”
Portions of the arrest were recorded by members of the public and posted on YouTube, he said.
The Office of the Police Complaint Commissioner was immediately notified and is monitoring the investigation, Hamilton said.

SEVEN on one i heard? if it was the old country we would have hung those kids in front of city hall. give those cops a medal.
i hope there are more cops on the island just like that. the video doesnt show the fight before the cops jumped in. .i hope im around to witness something like that and help the cops out.
How could a police officer do this? Clearly the man was doing nothing and agreed to get on the ground without resisting and he still got kicked! Police officers need to know when they need to start laying down force and when not to. Just the other day my friend got harassed by a police after she agreed to get into the cop car after her friend had been drinking a little to much and my friend was trying to get her home safely ( my friend of coarse had not been drinking) and the police officer pushed my friend into the police car with such force, making her hit the top of her head on the car as she was getting and bruising her forehead. I think officers think that they can do anything now, because ” they are police officers” and “have the right to do so” this is ridiculous.
There have been numerous prosecutions in the United States for violation of civil rights of citizens by cops. We don’t have similar laws although the Charter of Rights is clear. What the federal government should do is prosecute those cops who violate the constitutional rights of citizens apart from laying criminal charges. A key change that is needed urgently is for cops to stop probing cops. As journalists we have observed the spin we get from RCMP and other police jurisdictions about what actually happened in a given abuse situation relating to use of force. And our feeling is that once a press release with spin is put out, any sense of impartiality goes out of the window.
Drunk or not I don’t think the cops had the right to kick him the way they were that man was’nt doing anything, by the looks on the video.
The cops look like they just had a time of there life.
I’m happy about the young man who posted this on Youtube and there is now an investigation.
Very common. The bald one should volunteer for Afghanistan. All brawn and no brains. Arrest all in sight is the tactic. Here is my recent experience. All too common in Canada.
This might be classified as “Jackboots in the Night” My basic Canadian Human Rights were violated.
I was arrested, literally removed from my bed in a private dwelling, my home, Brantford on the 13 of February 2010 about 2300 hours by the Brantford Police based on a directive by the Attorney General of Ontario. (There must be an arrest when a domestic dispute is involved) The complainant was a third party to the situation. This was a so called domestic argument. I spent three days in jail before being released on bail. No J..P’s available on a long weekend.I consider this arrest and incarceration unjustified, illegal, and against the Charter of Rights and Freedoms. DETENTION OR IMPRISONMENT. 9. Everyone has the right not to be arbitrarily detained or imprisoned. I am presently awaiting a trial date in October. There was no assault. The charge will eventually be dropped, and I cannot go near my home for about six months. Justice- I think not.

I have no patience for tumultuous drunks, vandals, rioters, etc. and believe that most of the time, these people deserve to be handled with force, but in this case, I don’t know what the apprehended guys did before they were arrested, but really, the 2nd guy just calmly sits down, doesn’t do anything that remotely looks like he’s resisting arrest. Why the tackle and kicking? Again, I don’t have the details, so who knows, but it just doesn’t look like reasonable force.
The legal question will be: Did the policeman need to kick him? Our opinion is that this kind of force was not needed and the sooner cops learn about civil rights the better.
