I have heard several versions of the appeal session the morning of November 14 and the versions are certainly varied. With the intention of wanting to understand the actual proceedings, could you look into posting the transcripts? I believe the docket suggests that they have already been entered, though I may have misread that.

A major update from late October. There has been a ruling on a motion initiated by N. Tajdin intended to stay a prior ruling that he must provide un-redacted documentation regarding his supply chain, his financial transactions and distribution networks. The Justice has rejected N. Tajdin’s motion and clearly articulated numerous issues with it and chided Nagib’s behavior during a recent cross-examination.

In an ironic twist, the judge noted that while N. Tajdin made unsubstantiated allegations of the plaintiff’s legal team for having revealed confidential information resulting in N. Tajdin’s friends allegedly receiving threats, it was N. Tajdin via his own website that actually released the material! The hypocrisy was palpable.

It seems there are a number of major updates in this on-going saga of the Aga Khan vs Nagib Tajdin et al.

1. Incomplete submissions – The Aga Khan’s lawyers have expressed frustration to the courts with respect to incomplete submissions from the defendants. As an example, Tajdin et al. have not even provided the name of the printing house, and as such it is impossible to confirm if indeed all materials have been accounted for. As a way to ‘cut to the chase’ and limit the never ending delay tactics employed by Tajdin, a discovery where Tajdin and Jiwa can be questioned was requested, and the justice agreeing with the plaintiff, has demanded Tajdin and Jiwa present themselves for questioning early November.

2. A court date for the appeal has been set for November 14, 2011 – so we can look forward to closure soon thereafter.

3. While Tajdin has repeatedly spun the proceedings as a way for the Aga Khan to get more money from him, it has recently been learned that while Tajdin offered a blank cheque in return for not being asked to the stand for discovery, the Aga Khan rejected the offer in favour of instead Tajdin being made to answer questions on the record. It seems the Aga Khan is after truth and not money.

While I know that there are a group of people who remain in Tajdin’s camp and have rejected the direct communication from the Aga Khan, I suggest you ponder the following:

It is now only a matter of a few days. One would anticipate that the message from HH would be delivered directly by him to his followers in Nairobi and I’d urge Nagib to stay put there! The pretext will end in front of thousands of people. That is my hope and my humble opinion

Even if the appeal is dismissed, these people will continue living in their world of fantacy that they have created around themselves. These people are fanatics, they believe that they can never be wrong, and they have a mission! Their behaviour makes me sick!

Despite the meeting between the Aga Khan and Nagib and Alnaz, the claim filed by Nagib continues to maintain that the Aga Khan is not the plaintiff. This absurd claim is contrary to their pleadings before him begging for forgiveness of accusations of criminality against his aides. Not only that, it implies that despite the fact the Aga Khan turned up to be cross-examined by Nagib when he requested a court order to produce the plaintiff for discovery, the man maintains that the Aga Khan is not the plaintiff and all documents etc are faked including farmans that were read in Ismaili JKs. The implication of this claim is that the Aga Khan is not the plaintiff, that Nagib believes the Aga Khan misrepresented himself as the plaintiff, that the Aga Khan is in contempt of the court and that the Aga Khan turned up merely to cover for his aides. That is how I see it. Both Nagib and Alnaz are appealing the summary judgment but courts have not said if they will hear the appeal. In the meantime, NT had asked for several orders in the summary judgment to be set aside, as you can see from the documents. However, all but one of his requests, were rejected. There has been much in terms of propaganda about this case being over and that the Aga Khan is not involved in the case. Don’t believe a word of it. When the case if finally over, we’ll officially let you know through an article here. Meanwhile, NT and AJ are continuing their fight against the Aga Khan and by proxy against the top appointed aides to the Aga Khan.
